Rapport Caunhye : la Constitution violée « to pursue a secretive line of action »

L’ancienne présidente de la République passible d’Indictment sous les sections 64(1), 28(1)(b), la clause 77 du Criminal Code et des dispositions de la PoCA

« The President was operating in a closed setting, where no one other than those in Mrs Gurib-Fakim’s special team were admitted »

Des 172 pages (excluant les annexes qui portent le document officiel à 418 pages) du rapport de la commission d’enquête présidée par l’ancien chef juge, Asraf Caunhye, avec pour assesseurs la Senior Puisne Judge Nirmala Devat et la juge Gaitree Jugessur-Manna, le chapitre 8 – qui tient en une douzaine de pages – se présente comme l’Indictment Sheet contre l’ancienne présidente de la République, Ameenah Gurib-Fakim. En effet, après avoir analysé dans les sept précédents chapitres les faits à charge retenus contre la première femme devenue cheffe de l’État à Maurice, la Commission d’enquête énumère les différentes dispositions de la loi, en l’occurrence de la Constitution, qui ont été violées en mars 2018, avec des infractions corollaires sous le Criminal Code et la Prevention of Corruption Act (PoCA). Le fait majeur reproché à Ameenah-Gurib Fakim est d’avoir enfreint les dispositions de la loi suprême du pays, en Bypassing le conseil des ministres pour tenter d’instituer une commission d’enquête, dont la présidence avait été confiée à sir Hamid Moollan, QC, et doyen du Barreau mauricien.

En résumé au chapitre de l’institution de la commission d’enquête en date du 16 mars 2018, l’ancien chef juge et ses deux assesseurs soulignent qu’en dépit des mises en garde contre le caractère anticonstitutionnel de la démarche présidentielle, « Mrs Gurib-Fakim had chosen to discard both the Secretary to the President and any recourse to legal advice from the Solicitor-General in order to be able to pursue a secretive line of action which would best suit her personal agenda which would become apparent as she embarks into the setting up of her Commission of Inquiry ».

Plus loin, le rapport avance que « she should discard the Secretary to the President and the official administrative channel; avoid to consult the Solicitor-General for legal advice; and act contrary to the unequivocal legal advice of all her legal advisers, is very revealing of an attitude ;bent upon pursuing her hopeless bid to set up the Commission of Inquiry in utter contempt of the Constitution and the law ».

Auparavant, la Commission d’enquête avait fait sienne la thèse du Secretary to the President selon laquelle durant cette période « the president was operating in a closed setting, where no one other than those in Mrs Gurib-Fakim’s special team was adlmitted ». En guise d’entame à ce même chapitre, le rapport note que « by the use of the PEI credit card for her personal gratification, Mrs Gurib-Fakim violated section 28 (4) of the Constitution ».

Toutefois, quant au gros des arguments pour accuser l’ancienne présidente de la République de violation de la section 64(1) de la Constitution, le rapport s’appuie sur les tractations engagées à la State House en vue de forcer la main par rapport à l’institution de la commission d’enquête du 16 mars 2018. D’emblée, mention est faite que « the appointment of a Commission of Inquiry was not therefore a function which the President could perform ‘in his own delberate judgment’ or in any other manner except in accordance with the advice of Cabinet ».

Pour expliciter cette entorse à la Constitution, le rapport fait état des étapes et procédures adoptées pour la commission d’enquête sur la drogue en mettant en avant qu’en juillet 2015, « she was expressly briefed by Mr Dass Appadu, the former secretary to the president, as to the legal procedure for the setting up of a Commission of Inquiry and the need for the President to act in accordance with the advice of Cabinet for that purpose ».
Se basant sur les témoignages du secrétaire à la présidence de la République au sujet de l’épisode de mars 2018 de même que d’autres éléments versés lors des audiences, la commission d’enquête parvient à la conclusion que les Administrative Channels, les conseils des Personal Legal Advisers ont été tout simplement Discarded. Tout cela, au point où à la page 158, le rapport note que « the excuse of Mrs Gurib-Fakim that she felt isolated and could not have recourse to government legal advisers is wholly untenable ».

Plus loin, la Commission Caunhye souligne que « she failed to follow and chose to disregard the clear and unequivocal legal advice of all the other legal advisers to whom she had chosed to have recourse and who had, in no uncertain terms, warned her that she could not lawfully proceed with the setting up of the Commission of Inquiry without the approval of Cabinet. » A ce titre, le rapport cite à profusion des déclarations relatives des conseils légaux, dont le défunt Senior Member at the Bar, Yousuf Mohamed, Senior Counsel, ou encore Me Hervé Duval, Senior Counsel.

Le président de la Commission d’enquête et ses assesseurs vont jusqu’à citer verbatim un Text Message de Me Hervé Duval après l’annonce de la State House : « Dear Madam, I note with respect that you chose to ignore my advice which leaves me with no alternative but to decline to act further in relation to the constitutional issues ».

La Commission d’enquête accuse de nouveau Ameenah Gurib-Fakim d’avoir violé une autre clause de la Constitution, à l’effet que « it is incumbent upon the President in the execution of his or her duties to uphold and defend the Constitution. The President is mandatorily required to ensure that the institutions of democracy and Rule of Law are protected ». Pour preuve, elle s’appuie sur le libellé du serment auquel souscrit tout président de la République pour soutenir qu’elle a usurpé l’autorité de l’exécutif, notamment le conseil des ministres.

La conclusion de la Commission d’enquête est sans appel dans la mesure où Ameenah Gurib-Fakim « clearly failed to faithfully execute the Office of President in conformity with section 28(1)(b) of the Constitution and in compliance with the Oath which she had taken. She made an abusive use of her office and influence as President in several respects in order to serve the interests of Dr Sobrinho and his group of companies whilst at the same time taking advantage of the pecuniary benefits afforded by the Planet Earth Institute (PEI) card funded by the PEI Foundation ».

Sans transition, la Charge Sheet du paragraphe 8 du rapport s’attaque à d’autres actes commis présumément par l’ancienne présidente de la République sous d’autres lois. D’abord sous la section 77 du Criminal Code, qui considère comme un délit criminel « any arbitrary act, ordered or committed by a public functionary, an agent of, or person appointed by the Government where such an act is prejudicial to the Constitution of Mauritius ».

Puis, ce même chapitre aborde ce qui est présenté comme un « unlawful, improper and indecorous use of the Office of the President » avec la connexion Sobrinho Alvaro mise en exergue. « The evidence has brought into sharp focus the nature and extent of the favours and support which Mrs Gurib-Fakim indisputably caused to be provided to PEI and the Alvaro Sobrinho companies by making an improper and abusive use of her position as President of Republic; be it for the obtaining of banking or financial licences; for their unlimited and continuing access to VIP facilities at the airport; for raising funds for PEI or for promoting the various interests of Dr Sobrinho and his entities both nationally and internationally. »

Sous la Prevention of Corruption Act, six Counts sont identifiés contre l’ancienne présidente de la République, en l’occurrence un cas de corruption avec « any conduct whereby, in return for a gratification, a person does, or neglects from doing an act in contravention of his public duties »; « an abuse of a public office for private gain »; « any conduct whereby a person obtains, for himself or for any other person, any gratification for inducing a public official, by the exercise of personal influence, to do an act in the exercise of his duties to show favour to any person »; le délit de Public Official using his office for gratification, soit la calase 7 (1) de la Prevention of Corruption Act; le délit d’influencing public official sous la clause 9 de la PoCA ou encore trafic d’influence sous les sections 10 (4) et (5) de la PoCA.
En conclusion, le rapport avance que « whether Mrs Gurib-Fakim is amenable to any judicial proceedings is a matter which fall solely within the province of the authorities constitutionally and legally mandated to determine such matters; the Commission is however bound to inquire and conclusively report as mandated by its Terms of Reference ».
