ALLOCATIONS D’ÉTALS : Trois ex-conseillers municipaux coupables de conflits d’intérêts

Poursuivis pour conflit d’intérêts devant la Cour intermédiaire, l’ancien maire de Quatre-Bornes Roshan Munee Seetohul et deux anciens conseillers municipaux, Chetanand Pursun et Nirendranath Kumar Chady, ont été reconnus coupables vendredi par les magistrats Ratna Seetohul-Toolsee et Raj Seebaluck. Il leur est reproché d’avoir favorisé l’allocation d’étals à des proches. Dans leur jugement, les magistrats ont fait ressortir qu’« il n’y avait aucun doute que les trois accusés avaient favorisé leurs proches to the detriment of hundreds of other citizens of Quatre-Bornes who had taken part in this fierce competition ».
Les avocats des trois conseillers présenteront leurs plaidoiries quant à la sentence demain. Roshan Munee Seetohul, Chetanand Pursun et Nirendranath Kumar Chady étaient poursuivis pour conflit d’intérêts sous la Prevention of Corruption Act (PoCA). Il leur était reproché d’avoir favorisé l’allocation d’étals à des proches. Chetanand Pursun, Roshan Munee Seetohul et Nirendranath Kumar Chady – tous trois ayant une cinquantaine d’années – étaient représentés par Me Yousuf Mohamed (SC). La poursuite, elle, était menée par l’Assistant Chief Legal Adviser de la commission anticorruption, Me Kaushik Goburdhun. Chetanand Pursun était le président du Public Health Committee alors que les deux autres ex-conseillers en étaient membres. Lors d’une réunion le 31 juillet 2007, tous avaient approuvé les recommandations du sous-comité du Public Health Committee sur l’allocation d’étals à la foire de Quatre-Bornes se tenant tous les mardis et vendredis. Chetanand Pursun avait approuvé l’allocation d’un étal à son épouse Mucktasing Pursun et à ses deux soeurs Nowtee Rajcoomar et Oomawtee Tacouri. Roshan Munee Seetohul avait, lui, approuvé l’octroi d’un étal à son épouse Sandhya Devi Seetohul. De son côté, Nirendranath Kumar Chady avait approuvé l’allocation d’un étal à son beau-frère Ajay Kumar Boojwan. Dans leur jugement les magistrats ont conclu que « By approving the allocation of the stalls for their relatives, the accused parties in their capacity as elected councillors had unfairly favoured their close ones to the detriment of hundreds of other citizens of Quatre Bornes who had taken part in this fierce competition. Their guilty intention is found in the fact that they all knew their close relatives had applied for the stalls, but despite this, they took active part in the meeting to approve the allocation of the stalls without giving the prescribed written notice of their interest ».
