APPEL—COUPABLE DE TRAFIC D’INFLUENCE: La sentence infligée au SIW de Moka/Flacq cassée

Mohit Mungree, Senior Inspector of Works du conseil de district de Moka/Flacq (SIW-M/F), ne fera pas les trois mois de prison que lui a infligés la Cour criminelle intermédiaire. Son appel du jugement l’ayant trouvé coupable de trafic d’influence a été retenu par le full bench de la Cour suprême, composé des juges Eddy Balancy, Saheeda Peeroo et Asraf Caunhye.
L’appelant avait été poursuivi sous l’article 10 (5) de la Prevention of Corruption Act PoCA). Les particulars de cette accusation étaient qu’en tant qu’officier public, il avait sollicité un pot-de-vin de Rs 5 000 d’un dénommé Raj Gangaram, qu’il comptait remettre aux officiers du conseil de Moka/Flacq, qui travaillaient sur la demande d’un building permit. L’appelant avait plaidé non coupable.
Raj Gangaram, qui a rapporté cette affaire à la connaissance de l’ICAC, a déposé en cour. Il était le témoin N° 4. La magistrate qui a entendu le procès a résumé sa déclaration comme suit. « The complainant deponed to the effect that following complaints made to the Moka/Flacq District Council his filed was retrieved by the accused and the latter told him that he would call him and he did so and asked him to come to his place. He went to the place of the accused and he related his conversation with the accused. Witness N° 4 did not mention at all in court that accused told him that he had a Declaration Form to sign as per the version of the accused. He mentioned that accused told him that 75 % of his file was in order but he was not sure about the 25 % but if he gave him Rs 5 000 he would handle everything. He understood that if he gave Rs 5 000 the 25 % would be settled. He stated that he thought that accused would keep the money for himself to get his residential permit. It was then put to him that he stated in his statement to the police that he had to give Rs 5 000 to officers of the Moka Flacq District Council to have the residential permit approved and he agreed that he did say so. »
Les juges notent que les avocats des défendeurs, Me Preesha Bisnauthsing pour l’ICAC et Me Denis Mootoo pour le DPP, ont concédé « à juste raison » qu’ils ne pouvaient réfuter l’argument selon lequel il est possible « that an accused party charged with an offence particularised in a certain manner could be misled if in fact the alleged offence, according to the evidence, should have been particularised in a different manner, as in the present case. They (les deux avocats) also rightly conceded that they could not refute the argument that the accused in the present case has been convicted, as charged, of an offence which, as particularised, was not shown by the evidence to have been committed by him. »
Le full bench fait ressortir que le délit pour lequel l’appelant a été trouvé coupable, était qu’il avait sollicité un pot-de-vin pour d’autres personnes, en l’occurrence des officiers du conseil de district. En leur opinion, les juges estiment que la magistrate ne pouvait pas le trouver coupable selon l’accusation telle qu’elle a été rédigée ni qu’elle ne pouvait le faire avec différents particulars sans qu’il y ait un amendement à l’acte d’accusation en donnant l’occasion à l’accusé de présenter son plea à nouveau et en assignant des témoins plus concernés.
