JUGEMENT RENVERSÉ: L’ex-Marketing Officer de Baba Cool Ltd obtient gain de cause

La cour suprême agissant en appel a renversé un jugement rendu par la cour industrielle, qui avait rejeté la plainte logée par l’ancien Marketing Manager de la compagnie Baba Cool Ltd, une firme qui organise des sorties en mer à bord de catamarans. Patrick Sallaz Damaz, l’ancien employé, un skipper qualifié, soutenait avoir été injustement licencié.
L’employeur a soutenu que le Marketing Manager a commis une faute grave quand il a décidé d’annuler une sortie en haute mer le 13 mai 2009 puis une autre deux jours après. « The learned Magistrate found that the second charge had not been proved but that the first charge relating to the cancellation of the boat trip without authorisation on 15 May 2009 had indeed been established. The Court’s conclusion was that by cancelling without the autorisation of his employer, thus causing prejudice to the business, the plaintiff had committed a serious misconduct involving insubordination and justifying summary dismissal », rappellent le Senior Puisne Judge, Eddy Balancy, et le juge Saheed Bhaukaurally, dans le jugement qu’ils ont rendu concernant l’appel de Patrick Sallaz Damaz.
Analysant les raisons d’appel, les juges se demandent si 1) il y avait- une obligation pour l’appelant d’obtenir l’autorisation de son chef pour annuler une sortie ; et 2) si la réponse à la première question est affirmative, l’appelant s’est-il rendu coupable d’avoir commis une faute grave ?
D’après le témoignage de l’appelant, depuis huit ans, il a annulé des sorties sans l’autorisation de son chef. Il prenait sur lui pour décider s’il y avait lieu d’annuler ou pas. De son côté, son chef a donné une version contraire, quand il a soutenu que son employé avait l’habitude de lui téléphoner chaque matin pour discuter des conditions climatiques afin de décider s’il faut maintenir les sorties programmées ou les annuler. La magistrate de la cour inférieure a opté pour la version du patron « because cancellation or not of a trip is an important decision and involves financial considerations and therefore ought to be taken by the boss », a expliqué la magistrate.
Les juges eux sont d’un avis contraire à celui de la magistrate. Ils estiment que « the learned Magistrate was wrong in her conclusion that the plaintiff’s conduct amounted to gross misconduct justifying dismissal without payment of severance allowance. In our opinion the misconduct of the plaintiff did not call for dismissal and should have been dealt with otherwise. In the circumstances, we are of the view that the learned Magistrate erred in dismissing the plaint and should have awarded severance allowance to the plaintiff at punitive rate. »
De ce fait les juges amendent le jugement de la magistrate en ordonnant à la compagnie Baba Cool Ltd de payer à l’appelant la somme totale de Rs 679 302 avec les intérêts à compter de la date à laquelle Patrick Sallaz Damaz avait logé sa plainte en cour industrielle.
