SUR ORDRE DE LA COUR : Airway Coffee Co Ltd sous le contrôle de Yuvraj Thacoor

La juge Rehana Mungly-Gulbul a avalisé la nomination de Yuvraj Thacoor, Senior Partner de Grant Thornton, en tant que Provisional Liquidator de la compagnie Airway Coffee Co. Ltd de Nandanee Soornack. Cette décision a été arrêtée en dépit du fait que Madam Ou Kone ki Mwa, qui est en fuite en Italie depuis le 11 décembre 2014, a interjeté appel contre la décision de mettre en liquidation la société gérant la chaîne de restaurants au Sir Seewoosagur Ramgoolam International Airport. Aux termes de ce jugement et jusqu’à la conclusion des procédures d’appel, Yuvraj Thacoor assurera le contrôle d’Airway Coffee Co. Ltd, dont les dettes auprès d’Airports of Mauritius Ltd et ATOL sont de Rs 83 millions, et ce depuis 2011.
« There is therefore at this stage on the one hand the imperative need to secure the interests of Airports of Mauritius Ltd  and ATOL who have already obtained a judgment against Airway Coffee and to preserve the assets of the company which should be counterbalanced with any eventual rights which may accrue to Airway Coffee as a result of the determination of the appeal », note la juge.
En conclusion, Rehana Mungly-Gulbul affirme par rapport à cette composante de l’opération Lakaz Lerwa Lion que « subject to the condition to whatever powers the provisional liquidator may have under the Insolvency Act with regard to the realisation or distribution of the assets of Airway Coffee shall in the meantime be stayed, I appoint Yuvraj Thacoor as provisional liquidator, in whom shall be vested the administration and possession of the assets of Airway Coffee pending the determination of the appeal ».
