RAPPORT PRÉLIMINAIRE RENDU PUBLIC SAMEDI : Robertson propose l’institution d’une Media Commission

L’institution d’une Media Commission présidée par un Media Ombudsperson pour statuer sur les plaintes relatives à des inexactitudes ou à des injustices publiées dans les journaux ou diffusées à la radio ou à la télévision figure parmi les recommandations du rapport préliminaire qui a été rendu public par son auteur Geoffrey Robertson samedi. Le légiste britannique, qui insiste sur le fait qu’il porte l’entière responsabilité du rapport préliminaire, préconise également l’introduction d’une législation sur la liberté de l’information.

L'AXE SOORNACK/GOOLJAURY : Gagging Order, le droit à l'information prime

Un mois après le Gagging Order émis un samedi par le juge Bushan Domah contre les publications du groupe Le Mauricien et l'express à la demande de la femme d'affaires et activiste du Labour, Nandanee Soornack, le juge Eddy Balancy a tranché en faveur de la liberté d'expression et du droit à l'information du grand public. Dans un jugement motivé, rendu, mercredi dernier, le juge se basant sur une série d'Undisputed Facts relatifs à l'affaire Nandanee Soornack, soutient que celle-ci ne peut prétendre à garder loin du domaine public des aspects de sa vie privée. De ce fait, il a enlevé le Gagging Order contre ces deux groupes de presses à l'exception de la publication de tout autre détail sur la troisième enfant de Nandanee Soornack, qui est encore mineure. En fin de semaine, Me Yousouf Mohamed, Senior Counsel, dont les services ont été retenus par l'activiste travailliste, a signifié son intention de faire appel contre le jugement Balancy avec les documents relatifs logés en Cour suprême au plus tard mardi.

Les juges Saheeda Peeroo et Nirmala Devat, siégeant en appel, ont ordonné que le procès intenté à Automatic Systems Ltd (ASL) qui gère Supertote soit réentendu. La compagnie était poursuivie pour avoir permis à un mineur de miser au Tote.
