Le négociateur Gopee : « Nous allons réclamer la réintégration de Chetanand Rughoobur à son poste »
L’Employment Rights Tribunal (ERT) a tranché. La Banque de Maurice (BoM) doit reconnaître la Bank of Mauritius Employees Union (BoMEU) comme le “sole bargaining agent with sole bargaining rights in the bargaining unit” de la BoM.
Dans un Award rendu public hier, l’Acting Chairman de l’ERT, Indiren Sivaramen, et ses trois assesseurs, Anundraj Seethanna, Chetanand K. Bundhoo et Divya Rani Deonanan, écrivent que « the Tribunal thus has no hesitation at all in finding that the Applicant Union indeed has the support of more than 50 per cent of the employees in the bargaining unit. In the light of all the evidence on record and for the reasons given above and as there was no other point in dispute between the parties, the Tribunal orders that the Respondent is to recognize the Applicant as sole bargaining agent with sole bargaining rights in the bargaining unit consisting of employees of the Respondent. »
C’est sous l’article 36 de l’Employment Rights Act que la BoMEU, représentée par son négociateur, Narendranath Gopee, avait déposé une demande de reconnaissance auprès du tribunal après que la BoM avait remis en question la légitimité de ce syndicat.
« By way of a letter dated 26 May 2025, the Respondent informed the Applicant union that it was unable to process the application “in the absence of relevant supporting information requested by the bank”. Both parties have filed a statement of the case in the present matter and the Respondent was assisted by Counsel whereas the Applicant was assisted by its Negotiator. At the hearing of the matter, both parties agreed that the Respondent would carry out a verification exercise of the signatures appearing on a list provided to the representative of the Respondent. The latter would ensure that the exercise was carried out in strict confidence and in line with relevant legislation pertaining to the use and treatment of confidential information », soutient le tribunal.
Réagissant hier, le négociateur de la BoMEU, Narendranath Gopee, a déclaré que le syndicat avait déposé une demande auprès de la Banque Centrale en vue d’obtenir sa reconnaissance pour être le représentant des employés, mais que la direction de la BoM avait utilisé toute sorte de tactiques pour refuser cette reconnaissance syndicale. « Et c’est pourquoi nous avons décidé de faire appel à l’ERT. Après plusieurs mois de batailles, plusieurs années de bataille, l’ERT nous a finalement donné gain de cause. Il a donné l’ordre à la Banque de Maurice de reconnaître la BoMEU comme Sole Bargaining Agent et de démarrer tout de suite l’exercice de Collective Bargaining. Nous allons maintenant écrire à la Banque de Maurice pour demander à celle-ci d’émettre une lettre de reconnaissance syndicale à la BoMEU comme une Documentary Evidence. Maintenant que nos chemins sont ouverts, nous allons pouvoir négocier la réintégration de Chetanand Rughoobur, le président du syndicat, à son poste d’analyste. J’espère maintenant que tous les coups bas de la Banque de Maurice cessent et que les relations industrielles y retournent à la normale », a-t-il fait ressortir.
