Showkutally Soodhun fait face à un procès en Cour intermédiaire sous une charge de “abuse of authority by public officer” en violation de l’article 77 du code pénal. Le procès a été appelé hier, mercredi 6 février, devant la magistrate Meenakshi Gayan-Jaulimsing. Lors du procès, Me Ravind Chetty, Senior Counsel, a réclamé un autre un renvoi du fait qu’il n’a pas encore visionné la vidéo en question avec son client Showkutally Soodhun. La poursuite n’avait pas objecté à la requête de la défense. L’affaire sera de nouveau appelée le 12 février.
Il est reproché à l’ancien ministre de « being an agent of the government, wilfully and unlawfully commit an arbitrary act prejudicial to section 16(2) and (3) of the Constitution of Mauritius ». L’accusation faite contre Showkutally Soodhun se lit comme suit : « During a meeting held in the Board of the Ministry of Housing and Lands on the 17 July 2017, the said Honorable Showkutally Soodhun gave an undertaking to a group of persons, known as Regroupman de Bassin, that the NHDC houses in their locality would be allocated to persons in a discriminatory manner ».
La police avait conclu qu’il n’y avait aucun élément contre l’exministre mais le DPP a trouvé qu’il y avait « suffisamment de matière » pour des charges formelles suite aux propos à relent sectaire qu’il aurait tenus lors d’une réunion avec un groupe d’habitants de la route Bassin, QuatreBornes, en juillet 2017.
Neuf témoins ont été assignés au procès, soit des enquêteurs, des membres de la presse, Vivay Kanum Pursun et un certain Seewa Jankoo. La poursuite est représentée par Mes Medhi Manrakhan et Keschri Soochit.
