APPEL — LISING PERD FACE À LA MRA: Les carreaux en quartz frappés de 40 % de taxe à l’importation

La firme importatrice de carreaux céramiques Lising a perdu l’appel logé contre la Mauritius Revenue Authority (MRA). Celle-ci avait classifié les carreaux à base de quartz comme étant de ceux qui sont frappés d’une taxe à l’importation de l’ordre de 40 %. La firme avait contesté cette décision, qui avait été entérinée par l’Assessment Review Committee (ARC).
La firme a logé son appel par voie de Case Stated contre la décision de l’ARC sous l’article 21 (1) de la MRA Act 2004 et sous les ARC (Appeal) Rules 2007. Quatre raisons ont été données.
Elles sont : 1) Because the Committee was wrong, in the light of the evidence as well as the exhibits produced, to have come to the conclusion that the Quartzite had been further processed thereby necessitating a classification under heading 6802.99 ; 2) Because the Committee laid undue inference on the fact that « all the tiles have been cut to 300mm x 300mm in precisely cut to size » and that they have not been roughly cut ; 3) Because from all the own admissions of the representations of the Respondent (Ndlr : la MRA), it is obvious that the quartzite was cut or merely cut into slabs of a rectangular (including square) shape ; et 4) Because in all the circumstances of the case and having regard to the difference in the exhibits produced, it is obvious that the quartzite tiles should have been classified under 25.06.
Pour les juges Eddy Balancy et Saheeda Peeroo, le point qui a été soulevé est que les carreaux de quartzite auraient dû figurer dans la catégorie de Harmonised System (HS) Code 25.06 qui ne sont pas frappés de taxe à l’importation.
Après une analyse des explications fournies sur le produit en question, des lois et règlements en vigueur, les juges arrivent à la conclusion que la décision de l’ARC est juste. « We are of the view that the ARC has adopted the right approach and sought to determine the objective characteristics and properties of the quartzite tiles, as defined under the relevant headings, having regard to their physical appearance, composition and presentation », disent-ils dans le jugement qu’ils ont rendu il y a quelques jours.
