COUR INDUSTRIELLE : Pour n’avoir pas rapporté un accident au travail, Ultraclean Co Ltd reconnue coupable

La compagnie Ultraclean Ltd était poursuivie devant la Cour industrielle sous deux charges, soit de n’avoir pas assuré la sécurité au travail de ses employés et de n’avoir pas rapporté un accident qui s’était produit sur le lieu de travail. Un de ses employés s’était en effet blessé quand un élévateur télescopique s’est effondré sur son lieu de travail Place du Moulin, à Port-Louis. Ultraclean était poursuivie sous les charges de “willfully and unlawfully failed to notify forthwith the Director, Occupational safety and Health (the Director), by the quickest practicable means, of an accident arising out of work et willfully and unlawfully failed to send a report to the Director, Occupational Safety and Health within 7 days, a report of the accident”. Pour sa défense, la compagnie avait soutenu que le travailleur en question était employé à la State Property Development Corporation et qu’il n’y avait aucune raison pour elle d’informer le ministère du Travail de cet accident. La magistrate Ratna Seetohul-Toolsee a cependant conclu que l’employé était sous la responsabilité de la compagnie accusée. « Mr Babajee being employed by the accused company and having been subject to a dangerous occurrence which was the collapse of the lift which he was operating, it was incumbent on the accused company in its capacity as employer of Mr Babajee to comply with its duty and thus notify the Director of the dangerous occurrence by the quickest practicable means and send a report within 7 days of the collapse, which it has failed to do », a-t-elle souligné.
