COUR INTERMÉDIAIRE—Complot pour vol au travail : un employé relaxé

Poursuivi sous une charge de conspiracy en violation du Criminal Code, un employé de Deramann Management Ltd a obtenu le bénéfice du doute. La magistrate Ida Dookhy-Rambarrun a conclu qu’il n’y avait pas suffisamment de preuves pour établir qu’il était impliqué dans ce vol commis au travail.
Il était reproché à l’accusé d’avoir aidé un de ses collègues pour le vol de six boîtes contenant 48 conserves de corned mutton de la marque Vatsony. Le collègue en question était aussi poursuivi et a été trouvé coupable de vol. En cour, l’employé avait nié toute implication dans cette affaire soutenant que c’est un autre employé qui lui avait remis les 6 boîtes. « The prosecution had the burden of proving the following elements of the offence namely (1) an agreement, (2) between two or more persons, (3) to do an unlawful act. However, this Court finds that one of the essential elements of the offence, namely the agreement between the accused and witness 4, has not been established before this Court. Witness 4 was adamant in Court that he and the accused never agreed or made any plan to defraud Deramann Management Ltd », a souligné la magistrate.
