LA BALISE MARINA: Gain de cause aux promoteurs

Le juge Eddy Balancy a rejeté la plainte logée par des pêcheurs et les Forces Vives de Rivière-Noire qui contestaient la construction de la Balise Marina à Rivière-Noire. Le jugement est tombé vers 22h30 vendredi soir. Les travaux déjà entamés sur le site concerné, mais stoppés suite à un ordre intérimaire émis par le juge en août dernier, pourront reprendre.
Les plaignants – qui sont 1) les Forces Vives de Grande-Rivière-Noire, 2) l’Association Pêcheurs La Preneuse/Rivière-Noire et 3) l’Association des Pêcheurs Professionnels de Grande-Rivière-Noire – avaient saisi le juge en Chambre d’une action visant à interdire aux promoteurs – qui sont 1) Dolphin Coast Marina Estate Ltd et 2) West Island Ltd, toutes deux membres du groupe Espitalier-Noël Limited (ENL) – de poursuivre les travaux.
Le conseil de district de Rivière-Noire, les ministères de l’Environnement et du Développement soutenable, de la Pêche et de l’Agro-industrie, et la Central Water Authority ont été assignés comme co-défendeurs.
Dans un affidavit rédigé par l’avoué Me Sunil Luchmun, qu’il a juré en son nom et en celui des autres plaignants, Jean Noël Février, président de l’association plaignante N°3, a estimé que les défendeurs (le groupe ENL) « are presently carrying out extensive works (…) which are encroaching upon Public Domain, which includes the beach and part of the Black River Fishing Reserve. »
Le président de l’Association Pêcheurs La Preneuse/Rivière-Noire s’appuie sur un rapport rédigé par l’océanographe et l’ingénieur en Environnement Vassen Kauppaymuthoo. Il avait effectué plusieurs visites sur le site et avisé les plaignants sur les divers impacts qu’un tel projet peut avoir sur l’environnement. 
« In case the Respondents intend to proceed with the dredging of 33,000 m2 of an access channel in the lagoon of the declared Black River Marine Protected Area Fishing Reserve, it will cause irreversible environmental damage to the sensitive marine environment and ecosystem in this protected area which is used by skippers, fishermen, divers and the inhabitants of the area », souligne Vassen Kauppamuthoo.
L’expert en environnement s’appuie sur la demande du défendeur N°2 auprès du ministère de l’Environnement afin de lancer ses travaux. Cependant, précise-t-il, « it appears that works have already been started on the site and along the beach with the placing of rocks revetments around the project while the Environmental Impact Assessment (EIA) application is still under process. »
« I accordingly conclude that even if better preparation of the case by the applicants and their legal advisers might have resulted in a different conclusion being reached by me tonight, I must reject the written submissions filed in support of the application as being insufficiently substantiated. On the other hand, I have found the arguments of Messrs Collendavelloo SC and P. Doger de Spéville SC, Counsel for the respondents, and of Mrs Green-Jokhoo, Principal State Attorney, and Mrs Manna, Assistant Solicitor General (who stepped into her colleague shoes at the stage of the visit of the locus), Counsel for the Respondent Nos 2, 3 and 5 (les trois ministères précités) to be much more convincing. And I have no hesitation in holding that the applicants have failed to show that they have a serious case to be tried in an eventual Court case », écrit le juge en guise de conclusion sur les affidavits échangés et les débats qui ont marqué les discussions entre les parties concernées.
L’ordre d’injonction interlocutoire qu’il avait émis le 29 août 2011 a donc été annulé.
