MEURTRE DES BELLES-SŒURS JHURRY: Avinash Ramgotee se contredit sur plusieurs points

La troisième semaine du procès des meurtres des belles-soeurs Jhurry aux Assises a été marquée hier par l’audition d’Avinash Ramgotee. L’accusé a été le premier témoin à être appelé et entendu par la défense. Il a de nouveau été appelé à la barre ce matin par son avocat, Me Siv Potayya. Confronté à de nombreuses contradictions dans ses dépositions, Avinash Ramgotee a, durant presque cinq heures de contre-interrogatoire par le Principal State Counsel Me Medhi Manrakhan, gardé son calme, essayant à maintes reprises de donner des explications détaillées sur ce qui s’est passé. Il a jusqu’à la fin du contre-interrogatoire clamé son innocence.
Au début de son contre-interrogatoire, Me Medhia Manrakhan a questionné Avinash Ramgotee sur l’endroit où il habite actuellement et sur son travail. Il ressort que l’accusé habite actuellement à Roches-Noires dans une maison louée et travaille comme caissier à Sunrise Game. La poursuite devait alors lui demander s’il avait choisi de travailler dans cette maison de jeux car celle-ci porte le même nom sous lequel les habitants de Lallmatie le connaisse (ndlr : Avinash Ramgotee est connu par ses amis sous le nom de Sunrise). L’accusé a alors expliqué qu’il a travaillé dans plusieurs firmes privées mais quand ces dernières ont appris qu’il était le suspect principal dans une affaire de meurtre, il a été viré. Il a soutenu n’avoir pas eu d’autre choix que de faire ce travail. C’est un oncle qui aurait touché un mot au propriétaire de la maison de jeux pour qu’il y obtienne un emploi.
Me Medhi Manrakhan : Do you organise cash game after opening hours ?
Avinash Ramgotee : No
Me Medhi Manrakhan : Do you have two friends named Alain Jean and Joana Rose ?
Avinash Ramgotee : No I do not have any friends by those name.
Avinash Ramgotee est ensuite interrogé sur les études qu’il a faites et si a un moment il avait entrepris des études de droit. Il a été aperçu à maintes reprises assistant à des procès criminels et prenant des notes en cour.
Q : Are you a law student, have you been studying law ? Recently you have been attending court and taking notes in murder cases ?
R : Twice in the past I attended court of Flacq. My case was being called and the second time I was in Port-Louis and wanted to know how court proceedings take place.
Q : You were present during the case of Michaela Harte. Did you chose to attend the court as you knew that I was the state counsel and you wanted to see how I proceed ?
L’avocat de la défense devait objecter à cette question indiquant à la cour qu’Avinash Ramgotee ne pouvait savoir à ce moment-là qu’il allait être le représentant de la poursuite dans son procès.
Me Medhi Manrakhan l’interroge ensuite sur ses relations avec une de ses tantes qui habitait non loin de chez lui.
Q : Who is Jyoti Ramchurn ?
R : She is the youngest sister of my father. She now lives at Palma Road, in the past she used to live behind my house.
Q : Have you ever had any problem with her ?
R : She had a fight with my dad. She thought that I had stolen her MCB ATM card and had taken money out of the bank. She reported to the police.
Q : Had there been any other incident where she found you hiding in her house ?
R : No
L’accusé est ensuite interrogé sur sa présence chez les Jhurry au moment du drame.
Me Medhi Manrakhan : Do you know the Jhurry Family ?
Avinash Ramgotee : Yes since childhood. I knew his wife and knew that M. Jhurry had a sister but I never saw her. My father told me that she was sick and always stayed at home.
Q : Were you aware that M. Jhurry was earning a living as taximan, have you ever used his service ?
R : No
Q : Do you remember which car he had ?
R : I do not remember the model but I remember it was dark blue.
Q : You pass near M. Jhurry’s house everyday. How many times have you been in there ?
R : On the 5th of January 2006, it was the first time
Me Medhi Manrakhan : Was it the first time ever ? According to the statements, you went there twice, the second time to show the spots.
Q : First time you entered the Jhurry’s house, how long did you stay there ?
R : The first time I entered the house, I saw the lady and checked whether she was breathing. I stayed there for about 15 to 20 seconds.
Q : The second time, how much time you spent there ?
R : Much longer, about five minutes
Me Medhi Manrakhan : So we can say that you have been in the house for 5 minutes 30 seconds. For someone who has been in this house for the first time for only 5 minutes 30 seconds, you seem to know a lot of details.
Avinash Ramgotee : As a civil engineering student, you are trained to observe dimensions, largeur et profondeur.
Me Medhi Manrakhan : What largeur and profondeur were you observing there ? When M. Ramlogun was following you were you observing, what were you observing ? What have you seen ?
Avinash Ramgotee : When M. Ramlogun was in front of me, I was observing his clothing, expression and what he had in his hands.
Il est alors demandé à l’accusé de décrire le que portrait son oncle ce jour-là. Il répond que son oncle portait un jeans de couleur foncée, le même qu’il portait depuis plusieurs jours, une chemise à rayures. L’accusé répond qu’à un certain moment il était désorienté. Le Principal State Counsel devait alors lui demander comment a-t-il fait pour observer s’il était dans un tel état. Avinash Ramgotee répond qu’inconsciemment il enregistrait ce qu’il voyait. L’accusé est ensuite questionné sur le moment où il a allégué avoir vu son oncle caché dans la cuisine.
Q : Where you first saw M. Ramlogun ?
R : In the kitchen
Q : How did you end up in the kitchen ?
R : Starting from the living room, I entered a second room where the body was found. There I went straight, came out of the corridor, went into a room opposite to it.
Q : Where was the kitchen ?
R : In the back of the house. I found two bodies and I knew that the Jhurry family consisted of three persons, I was searching for M. jhurry.
Q : You knew M. Jhurry was a taxi driver, you knew his car was not there. Was there a car ?
R : I do not know, I did not have the time to see if the car was there.
Le Principal State Counsel lui demande alors de jeter un coup d’oeil aux photos montrant la face avant de la maison des Jhurry, là où est d’habitude est garée la voiture. Me Medhi Manrakhan insiste alors sur le fait que s’il était passé par la porte de devant comme il l’avait indiqué, cela aurait été impossible de ne pas remarquer la présence d’une voiture.
Avinash Ramgotee : Anyone in my case hearing this cry of distress…
Il est interrompu par Me Manrakhan qui lui dit que la première fois qu’il entrait dans la maison, il n’était pas supposé savoir ce qui s’était passé. L’accusé est ensuite interrogé sur ce qui s’est passé quand il était à l’intérieur de la maison des Jhurry.
Me Medhi Manrakhan : You saw M. Ramlogun in the kitchen. How did you know it was him, he had a cloth on his mouth.
Avinash Ramgotee : There was a door in the kitchen with window pane. There was light, there was moonlight.
Q : How do you know it was moonlight not light ?
R : There is a difference
Q : Did you see the moon ?
R : No I did not. People do not put natural light outside
L’accusé devait à ce stade à plusieurs reprises demander à Me Medhi Manrakhan de lui reposer sa question soutenant qu’il ne comprenait pas. Le Principal State Counsel s’est attardé sur comment il pouvait dire avec certitude que c’était la clarté de la lune alors qu’il n’avait pas vu de lune. Me Medhi Manrakhan lui a alors demandé comment il a reconnu son oncle avec la clarté de la lune et Avinash Ramgotee a répondu qu’il connaissait son oncle depuis son enfance et qu’il avait reconnu sa silhouette même dans l’obscurité.
Q : When you recognised your chacha in moonlight, what did he do ?
R : He was holding a knife and pointing it towards me and pushing me backwards
Q : How far ?
R : From the kitchen to the living room. I was at the doorstep.
Me Medhi Manrakhan montre alors à la cour la photo prise par la police sur laquelle l’accusé indique l’endroit où se trouvait son oncle. Le Principal State Counsel lui demande ainsi comment il a pu reconnaître son oncle quand lui était debout sur le seuil de la porte, qui était grande ouverte, et que son oncle se cachait derrière. L’accusé dit cette fois qu’il se tenait devant la porte. Me Manrakhan indique que si Rajesh Ramlogun tentait de se cacher, pourquoi serait-il devant la porte.
Avinash Ramgotee : In fact it was the first time that I entered this house, I was not familiar.
Me Medhi Manrakhan : What happened to your observation of engineer ?
Q : You say that you saw no blood on M. Ramlogun, don’t you find that strange ?
R : Yes I don’t confirm that I find that strange.
Q : What happened next ?
R : He said the following words : Dezabiy twa, mo pa pou fer twa nanyen, mo pou zis atas twa lor baro.
Q : How did he plan to do that ? Did he had any ropes ?
R : No, he had a screwdriver in his one hand which was in a position repos and a knife in the other hand.
Q : He had no rope, how was he going to tie you ?
R : I presume with my own clothes
Q : He would have had to free his hands and this would have given you time to runaway ?
R : Yes if it happened that way.
Q : Did you undress ?
R : Yes I removed my t-shirt.
Q : How large was the t-shirt ?
R : Even though I was thinner at that time, I used to wear double XL because of my braid shoulders
Q : When you wear that double Xl, its quite large. It covered a good part of your short.
R : Yes
Q : Explain how you manage to get off the t-shirt without removing your cap
R : By instinct, it was necessary for me to keep an eye contact with M. Ramlogun.
Q : How would removing the cap prevent you from keeping an eye contact ?
R : In no way. A normal person in a normal circumstance would have removed his cap.
Q : You were very skillful I assume. Skillful in a not normal circumstance.
Q : Why did you try to snatch the screwdriver from the hands of your uncle and not the knife.
R : If I had to snatch the knife, I would have had to seize the cutting part as he was pointing the knife towards. I just threw the t-shirt at him and ran away through the dining room.
Le Principal State Counsel s’attarde à ce moment-là sur les raisons qui l’ont motivé à emprunter tout le long de la salle à manger pour sortir par la porte de derrière alors qu’il aurait pu passer par la porte de devant. Avinash Ramgotee indique que son oncle se tenait devant cette porte, obstruant ainsi le passage. À un moment, il indique que les meubles étaient aussi disposés d’une façon qui lui rendait l’accès à la porte de devant plus difficile.
L’accusé devait expliquer qu’un canapé était sur sa gauche, obstruant ainsi l’accès à la porte d’entrée. La Poursuite a alors montré les photos de la maison indiquant que le canapé était au contraire situé plus près du couloir, par où Avinash Ramgotee soutenait être passé.
Me Medhi Manrakhan a consacré également une bonne partie de son contre-interrogatoire sur le moment où Avinash Ramgotee est arrivé devant la maison des Jhurry et au moment où il a soutenu avoir pris la fuite pour échapper à son oncle qui le pourchassait. Me Medhi Manrakhan lui a fait savoir qu’aucunes blessures n’a été trouvé sur son corps lorsqu’il a été examiné par le médecin légiste alors qu’il avait indiqué avoir couru dans les champs de cannes torse nu.
Avinash Ramgotee : By basic instincts, I put my hands in front of my face while I was running.
Me Medhi Manrakhan : There were no injuries on your forearm
À un moment, l’accusé soutient aussi que lorsqu’il a sonné à la porte pour s’enquérir il a entendu les sons provenant de la télévision. Quand Me Manrakhan lui demande s’il pouvait voir la télévison de l’extérieur, il devait répondre que non et qu’il entendait simplement les sons et pouvait savoir quel film jouait à ce moment-là car il avait regardé le même film la veille.
Me Medhi Manrakhan : When Mrs Indira Jhurry was on the phone with her sister, that was when you pressed the doorbell.
Avinash Ramgotee : No
Me Medhi Manrakhan l’a alors confronté à sa déposition a la police dans laquelle il avait déclaré qu’il était sorti ce jour-là acheter des cigarettes alors qu’avec des amis il avait affirmé avoir arrêté de fumer. L’accusé est aussi confronté aux dépositions faites à la police, surtout celle à la MCIT qu’il a déclaré à la cour avoir donné sous pression et signé sans son consentement.
Me Medhi Manrakhan l’interroge également sur ses sandalettes qui lui sont montrées en cour.
Q : Do you agree that they are clean ?
R : Yes the soles are quite clean.
Q : When examined by the FSL, there was no blood found. Who washed them ?
R : No one
Q : How do you know ?
R : I asked my family and they told me that they just récupère les sandales et les a gardées à la maison.
Q : Sandals were never found in your feet. Why would people be lying ?
R : I think this proves my goodwill, I could have denied that these were my sandals but I kept saying that they were mine.
Q : Where were the sandals found ? At your house. How can you deny there were yours ?
R : There are many people living in my house. M. Ramlogun was staying at my place during these days and he has same height as me.
Me Medhi Manrakhan : Are you sad you did not say it was M. Ramlogun sandals ? You could not explain how the sandals got to your house. You might have gone to your house after the murder.
Avinash Ramgotee : I totally disagree
Le Principal State Counsel le questionne par la suite sur la condition physique de son oncle.
Me Medhi Manrakhan : M. Ramlogun is a chacha. He is some 20 years older than you. You agree with me that he was not someone muscle ?
Avinash Ramgotee : He was more muscle than me
Q : You were more fit than him ?
R : I was not really fit, I did not use to do sports.
Me Medhi Manrakhan le confronte à sa déposition à la police dans laquelle il a déclaré que son oncle buvait tous les jours. L’accusé répond ainsi qu’il voulait dire que durant cette période, son oncle buvait tous les jours.
Me Medhi Manrakhan : Le 5 janvier, il n’était pas une personne fit alors puisqu’il buvait tous les jours. M. Ramlogun n’a pas pu être celui qui vous a agressé.
Avinash Ramgotee : Je maintiens que c’était lui.
La poursuite lui demande comment il n’a pas pu s’échapper face à une personne plus faible que lui. Me Medhi Manrakhan devait aussi lui faire remarquer que toute personne dans une telle situation aurait informé la police. « Si votre intention était vraiment d’aller à la rescousse de ces deux femmes, pourquoi n’avez vous pas dit à la police qu’il y a eu un meurtre dans la maison des Jhurry ? », a demandé Me Manrakhan.
Me Medhi Manrakhan : I put it to you that M. Ramlogun is not the murderer ?
Avinash Ramgotee : I do not agree
Q : I put it to you that M. Ramlogun was not on the murder scene ?
R : I do not agree
Q : I put it to you that you were not stab ?
R : I do not agree
Q : I put it to you that you invented the whole story and put the blame on your uncle ?
R : I do not agree
