PARLEMENT – DOMESTIC VIOLENCE BILL : La loi amendée pour mieux protéger les victimes de violences domestiques

Les amendements qui seront présentés par la ministre de l’Égalité des genres, Aurore Perraud, prévoient entre autres de renforcer les pouvoirs des officiers chargés de mettre en oeuvre les provisions de la loi. Dans ce contexte, la définition de « violence domestique » est élargie.
Les amendements au Domestic Violence Bill prévoient de tenir en ligne de compte tout acte de violence commis par une personne contre son épouse, un enfant de son épouse, ou une autre personne vivant sous le même toit. Ces actes seront considérés comme des délits condamnables et sont définis comme suit : « (i) willfully inflicting or attempting to inflict a wound or a blow, or threatening to inflict a wound or a blow ; (ii) willfully or knowingly placing or attempting to place, or threatening to place, the spouse or the other person in fear of physical injury to himself or to one of his children ; (iii) intimidating, harassing, stalking, ill-treating, insulting, or brutalising ; (iv) compelling the spouse or the other person by force or threat to engage in any conduct or act, sexual or otherwise, from which the spouse or the other person has the right to abstain ; (v) confining or detaining the spouse or the other person against his will ; (vi) harming or threatening to harm a child of the spouse ; (vii) causing or attempting to cause, or threatening to cause, damage to the spouse’s or the other person’s property ; and (viii) depriving, without any lawful excuse, the spouse or other person of resources which the spouse or other person is entitled to or requires, or of payment for rent in respect of shared residence. »
Un policier du rang d’assistant surintendant aura désormais le pouvoir de procéder à l’arrestation d’une personne qui en aurait blessé une autre à la suite d’un acte de violence domestique.
