PORT: Deux directeurs de CHCL réclament la réintégration d’Alain Edouard

La pression continue à monter dans le port avec le limogeage du président de la Port Louis Maritime Employees Association (PLMEA), Alain Edouard, par le board de la Cargo Handling Corporation Ltd (CHCL). Deux membres du conseil d’administration de la CHCL, Sada Kistnen et Mohenlall Bhundoo, ont écrit officiellement au Premier ministre adjoint et responsable du port, Xavier-Luc Duval, pour réclamer la suspension du Managing Director de la CHCL, Gassen Dorsamy, et la réintégration d’Alain Edouard. Les dirigeants de la PLMEA comptent également solliciter une rencontre avec le Premier ministre, sir Anerood Jugnauth, pour faire un tour d’horizon de la situation dans le port de même que le renversement de la décision du board dans le cas d’Alain Edouard.
Les deux directeurs de la CHCL ont soumis deux demandes spécifiques à Xavier-Luc Duval ce matin, soit « request the Chairperson of the CHCL to convene an urgent Special CHCL Board meeting to:  review its decision to dismiss Alain Edouard and to re-instate him with all his rights  and to put a motion to suspend Mr Gassen Dorsamy and Mr Dahari pending the CCID and Ministry of Labour inquiries on serious complaints made by Alain Edouard for criminal offences under the Employment Relations Act and Employment Rights Act ».
En préambule à ces deux demandes, Sada Kistnen et Mohenlall Bhundoo soutiennent que les procédures n’ont pas été suivies pour la convocation de la réunion du board visant au limogeage d’Alain Edouard. Plus particulièrement, des messages SMS ont été transmis aux membres directeurs à 20 h 25 le 24 mars pour la réunion du 25. Ils contestent également la manière dont le Chairman de la Sada Kistnen et Mohenlall Bhundoo, Robert Pallalmy, a présidé les délibérations.
« Through this arbitrary decision the Chairperson:  has breached the rights of one key stakeholder of the company, that is the employees of the CHCL, more so that Alain Edouard is also the President of the only recognized union of the company and himself a member of the Board; has deliberately decided to not make aware of all facts and circumstances to all members of the Board before reaching a decision on the case of Alain Edouard; has posed a serious risk of breach of directors duties as imposed upon by section 143 and 160 of the Companies Act 2001 as directors were not allowed to voice out their opinion freely. The Companies Act 2001 imposes the duties on directors to act in good faith and in the best interests of the company and also to exercise the appropriate degree of care, diligence and skill in the exercise of their duties; has omitted critical information which have lead public officers from different Ministries of the Government and State institution sitting on the Board of the CHCL into a situation where they have potentially breached of their duties under the Companies Act 2001 in as much as two directors representing employees were refrained from making the above motions. And has omitted information which has lead public officers from different Ministries of the Government and State institution sitting on the Board of the CHCL to take decision where they have committed an offence under the Employment Rights Act », font-ils ressortir à l’attention du Deputy Prime Minister.
