PRIVY COUNCIL — RENVOI INJUSTIFIÉ D’UN EMPLOYÉ: 3e revers pour la firme Smegh

Le Judicial Committee of the Privy Council a dans un jugement rendu lundi rejeté l’appel qu’a interjeté Smegh (île Maurice) Ltée contre un ancien Financial Controller, Dharmendra Persad. Il s’agit du troisième revers devant la justice pour la firme.
Dharmendra Persad, qui a travaillé du 25 octobre 1988 au 25 mars 2005 comme Financial Controller à l’hôtel La Plantation – établissement étant à l’époque sous le contrôle de la Smegh – a eu gain de cause pour sa plainte logée en cour industrielle. Cette instance lui a accordé la totalité de ce qu’il réclamait comme indemnités pour renvoi injustifié, plus de trois ans de salaires in lieu of notice – soit la somme de Rs 2 462 281.50 – et des intérêts de 12 %. Ce jugement a été rendu le 13 octobre 2008 par Benjamin Marie-Joseph, alors vice-président de la cour industrielle et nommé juge récemment.
Insatisfaite, la Smegh a fait appel devant la cour civile d’appel de Maurice. Treize des quinze points soumis contestaient l’appréciation du magistrat pour les témoignages formulés lors du procès en cour industrielle. Les juges ont cependant préféré analyser les accusations formulées contre Dharmendra Persad.
L’appelante a évoqué une décision administrative que son Financial Controller a prise sans l’autorisation du General Manager pour justifier son licenciement. La cour d’appel a néanmoins retenu la version de deux témoins assignés par l’ancien employé pour parvenir à la même conclusion que la Cour industrielle selon laquelle il serait déraisonnable de conclure que M. Persad avait mal agi.
« As a Court of appeal, we would interfere with the appreciation of the evidence of the trial Court and its findings if the trial Court had misdirected itself and its findings were manifestly wrong, perverse and unwarranted. After careful consideration of the submissions of learned Counsel for the appellant, we are unable to say that such is the case in the present matter and we would not disturb the findings of the trial Court », ont conclu les juges en instance d’appel.
La Smegh s’est ensuite tournée vers le Judicial Committee of the Privy Council (JCPC). Son appel a été entendu à Maurice le 29 mars par un board composé des Lords Hope, Brown, Mance, Dyson et Sumption.
Le jugement a été rendu par Lord Dyson au nom de ses confrères.
Les Lords estiment que la Cour d’appel « applied the correct test. In other words, the appeal could only succeed if the Industrial Court erred in principle by asking itself the wrong question or making findings which were perverse or manifestly wrong ». Citant le jugement G. Planteau De Maroussem v Dupou [2009], ils rappellent ce qui a été dit sur les comités disciplinaires : « The aim of a disciplinary committee, as we have said, is merely to afford the employee an opportunity to give his version of the facts before a decision relating to his future employment is reached by his employer. It is no substitute for a court of law, nor has it got its attributes. Furthermore, the employer is not bound by the recommendations of the disciplinary committee and is free to reach its own decision in relation to the future employment of his employee, subject to the sanction of the Industrial Court. »
Le JCPC approuve ce raisonnement et conclut avec les commentaires suivants : « This appeal must be dismissed. The Magistrate reached a conclusion on the facts which was plainly open to him. He heard the witnesses and made an assessment of their evidence. His decision was not perverse or manifestly ill-founded. Indeed, the contrary was barely argued before the Board. The only point of substance that was pressed on the Board was that to some extent the Magistrate based his findings on evidence that was not deployed by Smegh before the committee. But for the reasons given, this cannot avail it on the facts of this case. Since the decision of the Magistrate cannot be impeached, the Court of Appeal was right to dismiss the appeal. »
Les parties ont par ailleurs 28 jours, à compter de la date du jugement, pour soumettre en écrit leurs arguments.
