RÉCLAMATIONS DE LA MPL: Un propriétaire tenu de rembourser Rs 88 765.27

La magistrate Sheila Bonomally, siégeant en Cour intermédiaire, a ordonné à Ahad Maudarbux de payer la taxe municipale qu’il doit depuis 2010 à la municipalité de Port-Louis. Ce propriétaire d’un bien immobilier à Port-Louis devra ainsi s’acquitter de la somme de Rs 88 765.27 en plus de toute autre taxe municipale à payer jusqu’à la date du jugement final.
La municipalité de Port-Louis était ainsi en droit d’exiger d’Ahad Maudarbux qu’il s’acquitte du montant de la taxe municipale qu’il doit depuis 2010 car les documents attestent qu’il habitait bien rue Mohamed Sir Abdul Rajack, Port-Louis, depuis 2010.
La magistrate Bonomally, pour soutenir son jugement, s’est appuyée sur un extrait de l’affaire Berjeeraz R. vs. The Hong Kong and Shanghai Bank Corporation :  « Where on the day so fixed in the summons, or at any continuation or adjournment of the Court or cause in which the summons was issued, the
defendant does not appear, or does not sufficiently excuse his absence, the Court, upon proof of the service of the summons, may give judgment in terms of the plaint or, where the cause includes a claim for substantial damages,
proceed to the hearing of the witnesses and trial of the cause on the part of the plaintiff only, and in either case, the judgment shall, subject to subsection be as if both parties had attended ».
La magistrate Bonomally retient que les déclarations du conseil municipal de Port-Louis sont cohérentes. Ahad Maudarbux devra rembourser à la municipalité de Port-Louis Rs 88 765.27, représentant le montant de la taxe municipale due depuis 2010.
