Tout est à refaire. Mettre au frigo le précédent exercice d’appel d’offres. Annuler le contrat et redémarrer un nouvel exercice. Ainsi en a décidé l’Independent Review Panel (IRP), présidé par Me Hervé Lassémillante, concernant le contrat de transport de décents de Sotravic de La Laura à Mare Chicose pour un montant de Rs 100 220 000. La durée du contrat était de 36 mois.
Tout commence à la suite d’une contestation de la Compagnie régionale de Services et de l’Environnement Ltée (CRSE). Dans sa plainte déposée à l’IRP, celle-ci demande d’annuler le contrat car il y aurait conflit d’intérêts.
« By participating in the bidding procedures Sotravic Ltée places itself in a serious situation of conflict as it would certify the weight of waste brought in to Mare Chicose by its own trucks from the relevant waste stations. This is likely to give rise to bias and/or abuse. Sotravic Ltée is in a position of abuse given that as operator of Mare Chicose, it will be certifing and can be therefore manipulate, for monthly payments, the amount of waste incoming from any Transfer Station including those itself would be managing ? », soutient CRSE dans sa plainte.
Elle soutient aussi qu’en tant que gestionnaire du site d’enfouissement technique de Mare-Chicose, celle-ci est en possession du tonnage des déchets ainsi que des informations relatives aux autres soumissionnaires. Cet élément ne semble pas avoir été pris en considération lors l’allocation du contrat.
« The public body failed to take into account that Sotravic Ltée has supplied such information to the Public Body in the drafting of the Bidding Document and has hence a Relationship with the Public Body », avait-elle remarqué. Après avoir analysé la plainte, l’IRP dit ne pas constater que Sotravic Ltée ne peut pas avoir accès à des informations privilégiées dans l’exercice de préparation des documents d’appels d’offres.
En ce qu’il concerne l’allégation de conflit d’intérêts, l’IRB soutient qu’à La Laura, « the source or point of origin, the station would be operated by Sotravic » et que « we feel that a conflict cannot be exclused ».
Et d’ajouter en conclusion : « Given our observations above, we are of the view that the whole procurement proceedings should be annulled and started afresh.…) We believe that the prohibition of conflict actives, is it is indeed to remaind, should be thoroughly explored and clarified before another bidding exercise is carried out. »
