(Affaire Kistnen) Cour de Moka : Bhadain demande à assigner Sawmynaden comme témoin

À la fin de l’audience d’hier, Me  Bhadain a présenté une motion, soit pour que le téléphone du ministre du Commerce, Yogida Sawmynaden, ainsi que ses e-mails soient saisis et examinés. Il a aussi demandé que le ministre soit assigné comme témoin dans le cadre de l’enquête judiciaire, « as promptly as possible, for the truth to emerge and justice to be done and manifestly seen to be done ».

Cette motion se justifie, selon Me Roshi Bhadain, du fait des témoignages et révélations de plusieurs témoins entendus dans le cadre de l’enquête judiciaire, et dont le ministre du Commerce serait la « pièce maîtresse », pour faire la lumière sur ces événements. Et Me Bhadain de faire état notamment du témoignage de Shakuntala Kistnen, veuve de Soopramanien Kistnen, qui considère le ministre comme principal suspect dans le cadre de la mort de son mari, ou encore du témoignage du Constituency Clerk du Premier ministre, Sanjay Karria, du fait qu’il ne connaissait pas Shakuntala Kistnen comme étant la Constituency Clerk de Yogida Sawmynaden au No 8.

Et l’avocat d’effleurer par ailleurs l’implication du ministre du Commerce dans des contrats que Soopramanien Kistnen souhaitait obtenir ainsi que d’autres implications, soit dans le cadre du projet à Pomponette ou encore de l’arrangement pour que le défunt reçoive une somme de Rs 14 millions en trois tranches, devant débuter le 16 octobre 2020, jour où il a disparu.

Dans sa motion en Cour, Me Bhadain a fait état entre autres de

 » the involvement of Mr. Yogida Sawmynaden in the use of the building at Mere Barthelemy Street, Port Louis, where the District Council of Moka forwarded letters of awards to Rainbow Construction Ltd of the late Mr. S. Kistnen

 » the involvement of Mr. Yogida Sawmynaden in a proposed hotel project in the South and his dealings with the late Mr. Kistnen, Mr. Rocky Boodoo and Mrs. Miranda Meyer, also known as, Miranda Hartzenzerg

« the mobile phone given by Mr. Yogida Sawmynaden to Mr. S. Kistnen, whilst he was in the hospital

 » the incoming and outgoing phone calls as per the itemised phone bills produced in Court with regard to conversations between Mr. Yogida Sawmynaden and the late Mr. Kistnen

« the evidence given under oath by Mrs. Kistnen and Mr. Nishay Boodooa with regard to the altercation in Mr. Yogida Sawmynaden’s office between Mr. Yogida Sawmynaden’s bodyguard and the deceased, the late Mr. Kistnen, who had stated that if he does not die, he will “faire zot grainer couma zamalacs”

« the involvement of Mr. V. Appanah and Mr. D. Bonomally with Mr. Yogida Sawmynaden and the arrangement whereby the late Mr. Kistnen was supposed to receive Rs 14 million in 3 instalments starting from 16th October 2020, when he disappeared at La Louise and was later found dead in a sugarcane field, at Telfair, Moka. »
