AFFAIRE GAGGING ORDER : Nandanee Soornack répond aux affidavits jurés par les défendeurs

Nandanee Soornack s’est présentée en Cour suprême peu avant 9 h ce matin pour jurer deux affidavits versés par ses hommes de loi, Me Yusuf Mohamed SC, son avocat, et Me Cader Mallam-Hassam, au dossier de l’affaire Gagging Order. Dans ces documents, Mme Soornack, plaignante dans l’affaire, répond à certains points avancés par Jacques Rivet, directeur de Le Mauricien Ltd, et par Denis Ithier, directeur de La Sentinelle Ltée, dans leurs affidavits respectifs.
Dans ces documents, la plaignante soutient que l’on se sert d’elle comme bouc émissaire dans la bataille politique actuelle entre le gouvernement et l’opposition. « I aver that the statement if made by Honourable Pravind Jugnauth relates to the warfare between politicians and the respondents wish to use me as a scapegoat and the respondents Nos 1 & 2 (Ndlr : Le Mauricien Ltd et Jacques Rivet respectivement) are making a political issue out of it all », dit-elle.
Poursuivant, elle ajoute : « If at all Honourable Pravind Jugnauth has made allegations of my private life in his statement, these are scandalous, vile and can only come from a frustrated politician who is in conflict with the present government in which he was recently found part. Such statements of Honourable Pravind Jugnauth should not be taken as biblical truth. » Aussi, elle pense que tout ce que l’on aura avancé ne serait qu’ouï-dire, ce qui fait que, pour elle, l’on ne peut se baser sur ces déclarations alléguées. Mme Soornack assure également que rien dans son précédent affidavit ne peut être interprété comme une admission « of any extra marital affair with a high profile politician ».
L’affidavit dans lequel la plaignante répond à Denis Ithier est plus long. Elle commence par déclarer que « in fact what I stated was that it was well known that I am a political activist of the Labour Party and that I was a registered agent of the Labour Party at the last Municipal election 2012 and participated during that political campaign. I maintain that this does not make me a political figure ».
Nandanee Soornack, après avoir reproché à nouveau aux publications concernées par cette affaire de vouloir la rabaisser à travers des photos et des caricatures, « deny that in a democracy worthy of that name, the private life of a person and that of his/her children cannot be made subject matter of morbid news which can be harmful to the person aimed and to her family »… Elle nie avoir été arrogante en public et estime que toute femme respectable qui aurait été à sa place aurait été indignée d’avoir été photographiée sans son consentement. « I maintain that I was right to appeal to the police and secured the mobile telephone of that person who photographed me in person and to express my resentment », affirme-t-elle.
La plaignante demande que la partie ayant trait à sa pétition de divorce qu’elle avait logée contre son ex-époux soit retirée de l’affidavit du directeur de La Sentinelle. Elle réaffirme qu’elle a toujours nié toutes les allégations sur l’influence politique dans ses affaires de business. Pour elle les défendeurs « are using all sorts of pretext to bring me into te public light as someone corrupt by making mere allegations and speculations. I aver that the respondents are trying by all sorts of pretext, excuses and inventions to intrude into my private life and that of my family especially my minor child. »
