DEMANDE DE LA GSEA: Shakeel Mohamed invité à amender la PGA de 1991

Le président de la State And other Employees Federation (SEF), Radhakrishna Sadien, a réagi à l’arrestation d’Atma Shanto en début de semaine devant le parlement. Il a envoyé un courrier mercredi au ministre du Travail Shakeel Mohammed pour réclamer l’amendement de la Public Gathering Act (PGA) de 1991.
« The Federation notes with serious concern that despite its request forwarded to you on the 14th February 2011 for the amendement of the repressive and undemocratic Public Gathering Act 1991, yet no decisions have been taken by the Government up to now », explique dans un premier temps Radhakrishna Sadien. Celui-ci souligne que dans la première lettre datant du 14 février 2011, le syndicat avait attiré l’attention du ministre du Travail sur les conclusions du 351e rapport du Committee of the Freedom of Association of International Labour Organisation (Case No. 2616 of 2008) qui recommande un « full consultation with the social partners » en vue d’amender la PGA 1991 afin « d’ensure that any restrictions on the public demonstrations are not such as to impede in practice the legitimate exercise of protest action in relation to the Government’s Social and Economic policy ».
Un peu plus loin dans son courrier, le syndicaliste explique que depuis son existence, la PGA a été utilisée pour cibler les syndicats la plupart du temps. « The excessive powers vested upon the commissioner of Police has made the police to impose a lot of ridiculous restrictions on authorised peaceful gatherings. The manner in which this legislation is being applied by the authorities shows to what extent the PGA is being used to discriminate and to intimidate trade union representatives », allègue Radhakrishna Sadien.
Les alinéas (2) et (3) de l’article 8 de la PGA, qui indiquent respectivement que « Where a poll is to be taken on any day in electoral area under the Representation of the People Act, no public gathering shall, after 6 p.m on the eve of that day, be held anywhere in that electoral area » et « No public gathering shall be held in an electoral area on the day of, and on the 3 days following the declaration of the result of the poll at an election in that electoral area », n’ont jamais été appliqués lors des élections, alors que plusieurs partis politique commettent des infractions, commente encore le syndicaliste.
