MENACE D’INCENDIER : Un constable de la SMF en Cour intermédiaire

Jean Pascal Vadamalay, membre de la Special Mobile Force, est actuellement traduit en Cour criminelle intermédiaire (CCI) où il doit répondre à une accusation de « threatening arson ». L’incident pour lequel ce soldat âgé aujourd’hui d’une trentaine d’années est poursuivi a eu lieu le 16 mai 2009.
Selon l’acte d’accusation, « (…) on or about the 16th day of May 2009, at Regimental Medical Unit, SMF, in the district of Plaines Wilhems, one Jean Pascal Vadamalay, 25 years, Police Constable, Departmental Number 2445, residing at N° E02, NHDC, Tamarin, did wilfully, unlawfully and verbally threaten an individual with condition to set fire to a property, to wit : he entered the consultation room of the Regimental Medical Unit with a gas cylinder in which were present Dr Allen Chandra Rao Naraidoo and PC 9919 Meelun and addressed them the following words : “Krye serzan Teeluck sinon mo eklat partou” ». Il a pu être maîtrisé et arrêté.
Lors d’une précédente audience, Me Rama Valayden, qui assure la défense de l’accusé, a déposé une motion pour demander que son client soit examiné par un board médical, afin de déterminer s’il peut toujours faire face à un procès. La poursuite fera connaître sa position lors de la prochaine audience.
L’accusé a été examiné une première fois par le Dr Sudesh Kumar Gungadin le jour de l’incident. L’assistant surintendant Appajee était présent. Le Chief Police Medical Officer (CPMO) a trouvé que Jean Pascal Vadamalay était dans un état dépressif, tout en étant conscient et cohérent. Il a été référé au Brown Séquard Mental Health Care Centre.
Le Dr P. Jagarnath, psychiatre de l’hôpital, a trouvé que l’accusé était « well mentally and could stand trial ». Il a également soutenu que Jean Pascal Vadamalay, qui avait été examiné le 13 juillet 2009, lui a paru dans un état tout à fait normal.
