CEB—INGÉNIEUR MÉCONTENT: Naden Pooleecootee retire la plainte logée devant l’EOT

Naden Pooleecootee, Cadet Engineer au Central Electricity Board (CEB), a retiré, fin de semaine dernière, la plainte qu’il avait logée contre le board devant l’Equal Opportunities Tribunal (EOT). Il s’était plaint de ne pas avoir été promu Senior Engineer, et ce malgré son ancienneté. La raison, selon lui, découlerait de son « appartenance ethnique ». Un argument qui ne tient pas la route, selon Me Jamseed Peeroo, avocat du CEB, expliquant que la personne ayant été nommée est de la même communauté que celle du plaignant. Suite à ce développement, le tribunal, présidé par Denis Vellien et composé des assesseurs Mohini Bali et Abdool Kader Lotun, la plainte a été rayée.
Dans son “Statement of Case” daté du 10 décembre 2013, le plaignant avait dit avoir assumé l’intérim au poste de Senior Engineer pendant plusieurs années avant qu’un autre employé soit finalement nommé à ce poste. Le CEB a logé son objection le 27 décembre 2013, se plaignant que le tribunal « has no jurisdiction to hear and determine the complaint subject matter of this present case inasmuch as : (i) The Complainant (Ndlr : Naden Pooleecootee) has failed to give any evidence or to state that he has complied with section 25 (5) (a) of the Equal Opportunity Act 2008 prior to filing of its statement of case ; (ii) The grounds on which the Complainant is relying in his statement of case are fundamentally different from that made before the Equal Opportunity Commission ; and (iii) The decision of the Equal Opportunity Commission to refer the Complainant before this Tribunal is being challenged before the Supreme Court of Mauritius by way of Judicial Review and the application for leave to initiate Judicial Review has been mentioned to the 20th January, 2014 ».
Le 13 février, il avait déposé son objection préliminaire. Ce point est libellé comme suit : « The Tribunal has no jurisdiction to hear and determine the subject matter of this present case inasmuch as : (i) The Respondent will be denied a right to a fair trial for the Tribunal is already in possession of all the minutes of proceedings, including conciliation proceedings held before the Equal Opportunities Commission ; and (ii) Since the Tribunal is already in possession of conciliation proceedings, which is inadmissible evidence, the Tribunal cannot hear and determine the present matter. »
Dans leur arrêt, les juges Nalini Matadeen et David Chan Kan Cheong ont rejeté la demande de Judicial Review de la décision.
