COUR DE ROSE-HILL: Accusé de complot

La magistrate Meenakshi Bhogun-Ramjutton, siégeant à la division de Moka de la Cour de Rose-Hill, a rejeté la demande de Saboob Domun de lever l’ordre d’interdiction de voyager qui pèse sur lui depuis son interpellation par la police, au début du mois de juin. Il est provisoirement accusé de complot
Saboob Domun est considéré comme étant un hors-la-loi, vu qu’il détient trois passeports, dont deux mauriciens, l’un sous le nom de “Saboob Domun” et l’autre “Sawood Domun”. Pour son troisième passeport, qui est britannique, l’immigration du Royaume-Uni l’a condamné à l’amende pour avoir enfreint les règlements.
Le dénommé Domun a fait présenter une motion pour que l’interdiction de quitter le pays soit levée. Il a justifié sa demande en disant qu’il comptait se faire soigner en Grande-Bretagne. La magistrate a préféré retenir l’argument de la police, qui, objectant à la motion, a soutenu que si le suspect quittait le pays, il y aurait de fortes chances qu’il ne réponde présent pour faire face à la justice lors de son procès.
Dans son ruling, la magistrate a émis les commentaires suivants sur la façon dont elle juge la personne de Saboob Domun.
« I have seen the applicant and I must acknowledge that he did not make a favourable impression on me. His immigration profile is astounding, his explanation given throughout unconvincing, the documents filed in highly suspicious and the reasons supplied to travel dubious. A person who, despite being the holder of a British passport and a Mauritian passport, would go to a draconic length to deceive all the relevant authorities, by falsifying important documents like act of birth, national identity card to have yet another passport under completely false identity, is a dangerous person, an outlaw, who has no respect for the rule of law and does not inspire trust. I would go further by stating that his series of unlawful acts did not end in Mauritius. He has boldly been flaunting himself under a fake name and a fake passport even in UK and has been illegally deriving all the benefits of a British citizen for years. It is hard for me, for these reasons, to believe this person when he swears to abide by the conditions imposed by Court, when he had shown utter regard to the basic principles of law and natural justice. His deeds are so heinous that his feeble remorse shown towards Court cannot operate as a veil. He even had the indecency of denying that he had a fake passport upon important questions put to him and he prevaricated when answering those questions. He clearly appeared to be untrustworthy and of utter bad faith and he clearly gave me the impression that he was all bent to flout the jurisdiction of the Court for his personal gains. »
Par ailleurs, en ce qui concerne les soins qu’il voulait obtenir en Grande-Bretagne, la magistrate note que Saboob Domun n’a produit aucune attestation médicale présentant son état de santé et qui aurait permis de corroborer ce qu’il a avancé.
Elle dit aussi ignorer le casier judiciaire du suspect, notamment ses précédentes condamnations, même si « a precedent conviction is not even a condition precedent to the making of the order ». Mais le fait qu’elle retient le plus est les démêlés qu’il a eus avec les autorités de l’immigration.
