INDUSTRIELLE—RENVOI INJUSTIFIÉ: Un ex-storekeeper compensé au taux punitif

La Cour industrielle a ordonné à la compagnie Top Notch de payer à son ancien storekeeper, Rajendra Mooken, la somme de Rs 256 473,12 pour renvoi injustifié. Il avait été licencié en mai 2011 pour avoir proféré des insultes à l’égard du directeur. Cependant la présence du directeur Ravi Rambujoo au comité disciplinaire a été perçue comme un conflit d’intérêt.
Dans sa plainte Rajendra Mooken avait soutenu qu’il était employé en tant que storekeeper dans la compagnie Top Notch depuis 2007 et qu’il avait été licencié en 2011 sans avis ni justification.
Lors du comité disciplinaire auquel assistait le directeur de la compagnie, des témoins ont confirmé que Rajendra Mooken avait prononcé des insultes à l’encontre du directeur de l’entreprise.
Cependant, la magistrate Ratna Seetohul-Toolsee estime que le directeur a été juge et arbitre et que de ce fait, le plaignant n’a pas eu droit à un comité disciplinaire juste et équitable. « This court is of the view that as member of the disciplinary committee, the company director might not have kept an impartial mind as the filthy words were destined to him. The small structure of the company staff cannot justify the presence of the company director in the disciplinary committee. He cannot be judge and party at the same time. There subsists a reasonable suspicion of a real likelihood of bias on the part of the company director who sat to hear the proceedings of the disciplinary committee instituted against the plaintiff who made him the subject of a verbal attack to enable the company director to assess the evidence and in the light of which the decision was taken to sack the plaintiff as the charge was found proved. Hence, the plaintiff was not given a fair hearing as envisaged by s 38 (1) (ii) of the Employment Rights Act 2008 », a souligné la magistrate dans son jugement.
La compagnie Top Notch devra payer la somme de Rs 256 473,12 à son ancien storekeeper Rajendra Mooken pour renvoi injustifié.
