PEINE DE PRISON ANNULÉE : Le jockey Bardottier gagne en appel

En 2014, Jeannot Bardottier fut trouvé coupable sous trois chefs d’accusation, et condamné à une amende de Rs 5 000 ainsi qu’à une peine d’emprisonnement de deux semaines. L’accusé avait fait appel de la décision du magistrat concernant la peine de prison, et la Cour avait ordonné à ce que le procès soit entendu de nouveau. Il avait alors été condamné à une semaine de prison et avait interjeté appel une fois de plus. Vendredi, sa condamnation a été annulée, les juges indiquant entre autres que « la charge avait été logée contre l’accusé en dehors du délai prescrit par la loi. »
Jeannot Bardottier fut trouvé coupable en 2014 de trois chefs d’accusation en Cour de Pamplemousses, en l’occurrence « driving without due care and attention », « failing to report accident » et « driving motor vehicle whilst under disqualification ». Il avait alors écopé d’une amende de Rs 5 000 et d’une peine d’emprisonnement de deux semaines. L’accusé avait toutefois fait appel du jugement concernant la peine d’emprisonnement.
Lors du premier procès en appel, le Chef Juge et le Senior Puisne Judge avaient conclu qu’une amende aurait été plus juste et avaient réclamé un nouveau procès.
Au nouveau procès, Jeannot Bardottier avait été condamné cette fois à une semaine de prison sous la troisième charge. À la suite de la décision du magistrat, son permis de conduire lui avait été retiré pour une période d’un an. L’accusé avait alors contesté la sentence du magistrat la jugeant « wrong in principle and harsh and excessive ».
En appel du nouveau procès, l’homme de loi du jockey, Me Rama Valayden, avait avancé que la charge contre son client avait été logée 18 mois après le délit, ce qui était en dehors du délai prescrit par la loi. Pour cause, l’article 53 (5) de la Road Traffic Act donne un délai maximum d’un an pour loger la charge. L’homme de loi avait aussi avancé que la Cour de district de Pamplemousses n’avait pas la juridiction appropriée pour condamner Jeannot Bardottier.
Siégeant en appel, les juges Nirmala Devat et Benjamin Marie Joseph ont trouvé plusieurs « irrégularités » quant au cours du procès intenté à Jeannot Bardottier. « In the present case, the offence as averred in the information took place on 19 October 2009. The information was lodged on 16 May 2011, nearly more than 18 months of the date of the commission of the offence. The information having been laid more than six months after the commission of the offence, it would have been incumbent on the prosecution, in line with the above decisions, to indicate in the information or from the evidence, such particulars as to satisfy the requirements of paragraph (b) of section 53 (5) of the Act, namely that the prosecution was being lodged both within three months from the date on which it came to the knowledge of the prosecutor and within one year from the date of the commission of the offence », cite le jugement rendu vendredi.
Les juges ont également trouvé que le magistrat de la Cour de district de Pamplemousses n’avait pas la jurisdiction pour entendre l’affaire. Ils ont cité l’affaire Rambarran v/s The Queen : « When a prosecution is based on an information which shows, ex facie its contents, that the offence charged therein is time barred, there is clearly lack of jurisdiction and such jurisdiction cannot be established by a plea of guilty, since such plea can have no legal value when given in answer to a charge laid in an information which is void of effect ab initio. In the present case, as already observed, the prosecution was time barred and, if it could avail itself of the exception provided by paragraph (b), this should have been made clear from evidence adduced to that effect, the information itself being silent on the point. »
