La suspension d’Arvin Boolell au Parlement ayant déjà pris fin en novembre, les hommes de loi du Speaker, Sooroojdev Phokeer, estiment que sa demande de Constitutional Redress n’est plus d’actualité. Dans un jugement interlocutoire rendu, hier, les juges Karuna Devi Gunesh Balaghee et Denis Mootoo donnent raison à Arvin Boolell et soulignent que bien qu’il ait repris sa place au sein de l’hémicycle et que sa suspension a pris fin, il y a toujours un Live Issue sur lequel la Cour est appelée à se prononcer. Les juges souhaitent prendre connaissance d’autres arguments avant de déterminer si les droits d’Arvin Boolell sous les sections 3, 12 et 16 de la Constitution ont été bafoués.
Arvin Boolel, qui a insisté pour que la Cour se prononce sur les agissements du Speaker remporte une première manche. “We consider that the defendants and the third party have failed to establish that there is no longer any live issue as a result of the lapsing of the plaintiff’s suspension from the National Assembly in so far as the alleged breach of his rights under sections 3, 12 and 16 are concerned. We wish to reiterate that we are not hereby making any determination regarding the question whether the plaintiff has a claim for redress under sections 3, 12 and 16 of the Constitution ex facie the plaint. This is a question which can only be determined after full arguments have been heard from the plaintiff, defendants and the third party thereon”, ont fait ressortir les juges.
Lors des débats en mars, le conseil légal du Speaker, Me Ravind Chetty, Senior Counsel, avait fait ressortir que cette affaire n’étant plus d’actualité et que la Cour ne peut rendre un jugement. De plus, il soutient qu’il n’y a aucun fait exceptionnel dans cette affaire nécessitant une déclaration de la Cour.
Les juges relèvent que la demande d’Arvin Booell n’étant pas d’annuler sa suspension mais de demander à la Cour de déterminer si ses droits constitutionnels avaient été bafoués. Les juges ont trouvé qu’il ne s’agissait pas la d’une affaire de révision judiciaire d’une décision et que la Cour pouvait intervenir à ce stade.
“ However, we are not dealing with an application for judicial review nor are we being asked to quash decisions taken by the defendants, but as stated, we are being asked to exercise our constitutional jurisdiction as guardian of the Constitution”, disent-ils en ajoutant que :
“The wording of section 17 is different from that of section 83.Section 17 is applicable, in cases where any of sections 3 to 16 has been, is being or is likely to be contravened in relation to a person. However, contrary to section 83of the Constitution, the proviso to section 17(2) does not limit the power of the Supreme Court to grant relief only in cases where the interests of a person are being or are likely to be affected by the alleged breach of any of sections 3 to 16”, affirment les ju
