TÉMOIGNAGE ACCEPTÉ : L’appel de l’auteur d’un acte indécent rejeté

La cour suprême a donné raison à une magistrate de la cour criminelle intermédiaire d’avoir accepté le témoignage d’une fillette de 9 ans, qui a été victime d’un acte indécent commis sur sa personne par son cousin, un jeune homme de 24 ans. Les juges Saheeda Peeroo et Abdool Razack Hajee Abdoula ont rejeté l’appel qu’avait logé l’accusé pour contester le jugement prononcé contre lui. La sentence qui lui a été infligée, six mois de prison, est donc maintenue.
Selon la version de la poursuite, qui repose essentiellement sur celle qu’a donné à la police la complainant (victime), l’incident remonte au 21 juillet 2007. La fillette se trouvait chez sa grand-mère maternelle lorsque son crayon s’est cassé. Elle s’est alors rendue chez son cousin (l’accusé) pour lui demander un taille-crayon. Il lui a répondu qu’il n’en avait pas. Il lui a demandé si elle voulait venir « jouer ». la plaignante a répondu par la négative, mais l’accusé l’a tirée de force par la main pour l’amener dans sa chambre, où il a joué un film tout en la caressant de manière indécente. Puis, à un certain moment, la grand-mère a appelé sa petite-fille. Avant de la laisser partir, il lui aurait dit : « Si to dir kik dimoun, to va gete seki mo pou fer twa ».
Dans une déposition donnée à la police, l’accusé a nié les faits qui lui ont été reprochés. Il a déclaré qu’effectivement sa jeune cousine était venue chez lui pour chercher un taille-crayon. La fillette l’a suivi dans la chambre de son frère. Elle a enlevé le blouson qu’elle portait en disant qu’il faisait chaud. Alors que l’accusé aiguisait son crayon, sa grand-mère l’a appelée. Elle a alors quitté la chambre, tout en laissant son blouson. Il l’a appelée pour le lui remettre.
« On the basis of the above evidence, the Learned Magistrate came to the conclusion that although the testimony of the complainant might have appeared “weak and incoherent”, she could nevertheless act safely on the testimony of the complainant and found the charge against the appelant proved beyond reasonable doubt », disent les juges.
Ils rejettent les quatre raisons soumises pour soutenir l’appel, dont celle qui a trait à l’âge de la plaignante. Sur ce point ils soulignent que « as rightly submitted by learned counsel for the respondent (l’État) and as rightly concluded by the Learned Magistrate, the contradictions highlighted by counsel for the appellant were not of a nature to affect the complainant’s credibility as regards her version of the incident itself which has remained consistent throughout her testimony. It can hardly be expected of a nine year old to recount an event in a chronological order and with mathematical precision. »
Les juges font remarquer également que la magistrate a noté qu’en dépit d’un rappel partiel des détails lors de l’incident du 21 juillet 2007, ce dont s’est souvenu la présumée victime « was strikingly consistent with the original version she gave to the police. It cannot therefore be said that the Learned Magistrate erred in finding the against the appellant proved nor can it be said that the Learned Magistrate failed to objectively and impartially assess the evidence in front of her ».
