TRAVAUX : Rejet d’une réclamation de RKLM Pro Services

RKLM Pro Services, qui avait effectué des travaux mécaniques et électriques dans le centre commercial de New-Grove, réclamait de ce dernier une somme de Rs 1 683 750 pour des travaux complétés dont le paiement n’avait pas été reçu. Le juge Paul Lam Shang Leen, siégeant en Cour suprême, a cependant rejeté la demande car la plaignante n’a pas réussi à convaincre la Cour que le Centre Commercial de New-Grove lui devait effectivement cette somme. Dans son jugement, Paul Lam Shang Leen se dit non satisfait de la façon dont la compagnie a présenté sa réclamation. « I find that there is no basis for claiming that 95% of the work had been done. I have not been told how that percentage had been arrived at. I would have expected the plaintiff, in view of the defence, to tell me regarding each of the ten listed items of the quotation, the amount of the work done under each list. The difficulty as righlty pointed out by the defence’s electrical engineer is compounded by the absence of details for each of the works described », écrit-il.
