L’affidavit juré hier note que « there is more than reasonable suspicions and more than a Prima Facie Case » contre le ministre du Commerce de L’Alliance Morisien
En cette fin d’année, avec l’enquête judiciaire sur le meurtre de Soopramanien Kistnen, âgé de 52 ans, ajournée devant le tribunal de Moka, un autre volet de la Telfair Saga, aussi compromettant que les circonstances de ce drame du vendredi 16 octobre, remonte à la surface. Ainsi, comme indiqué dans l’édition d’hier du Mauricien, Shakuntala Kistnen, aussi connue sous le nom de Simla, a juré un affidavit, informant l’Office of the Director of Public Prosecutions d’une Private Prosecution pour le délit présumé d’emploi fictif avec l’affaire de Constituency Clerk reproché au ministre du Commerce, Yogida Sawmynaden.
Dans le document légal, l’épouse de l’ex-agent du MSM de Quartier-Militaire/Moka (No 8) cible le Premier ministre et leader de L’Alliance Morisien, Pravind Jugnauth, pour le soutien inconditionnel à Yogida Sawmynaden dans la Telfair Saga. Elle a aussi dénoncé le fait que ce dernier est passible d’une inculpation provisoire dans cette affaire que l’ICAC et la police ne semblent pas vouloir faire diligence pour assumer leurs responsabilités.
La Private Prosecution, qui dépendra de la décision du DPP, est axée sur le scandale des Constitutency Clerk Fees de Rs 15 000 quand, à sa surprise, elle devait apprendre pendant le Lockdown qu’elle n’avait pas droit au Self Employed Assistance Scheme de la Mauritius Revenue Authority, même si elle vendait des “dhollpuris” à son propre compte à son domicile. La raison était qu’elle était enregistrée officiellement en tant que Constituency Clerk du ministre Sawmynaden pour le No 8.
« Upon further investigation from, inter alia, the Mauritius Revenue Authority and the National Pensions Scheme, I and my late husband were astounded to learn that I was allegedly employed as constituency clerk with Hon Minister Yogida Sawmynaden and that I have been allegedly perceiving a monthly salary of Rs 15, 000 from the Minister during the year 2020 and that my contribution regarding my employment has been paid to the National Pensions Scheme. My late husband was very angry with the Hon. Minister », devait soutenir Simla Kistnen.
L’épouse de feu Soopramanien Kistnen dénonce que, malgré une déposition en bonne en due forme au QG de l’ICAC, le 8 décembre, à l’effet que « there is more than reasonable suspicion and more than prima facie case against Hon Minister Yogida Sawmynaden which would justify an interview under caution, an immediate arrest as well as a provisional charge against him », ni l’ICAC ni la police n’ont encore initié d’enquête dans ce scandale impliquant des fonds publics.
Plus loin, Simla Kistnen ajoutera : « I was dumbfounded to learn that the Hon Prime Minister and Minister of Internal Affairs, has publicly reiterated his total support to cover up Hon Minister Yogida Sawmynaden on Sunday 20th December 2020 at Arya Samaj of L’Avenir, St Pierre. A couple of weeks earlier, he had also stated that he has carried out his own investigation and found that Hon Minister Yogida Sawmynaden has nothing to do with the Kistnen case. » Elle fera également ressortir que le Premier ministre, Pravind Jugnauth, et l’Attorney General, Maneesh Gobin, s’en sont pris publiquement contre des hommes de loi, qui ont offert leurs services Pro-Bono.
Dans la conjoncture, celle, dont le nom est cité dans cette sinistre affaire d’emploi fictif sous les National Assembly Regulations, affirme « “regretter” the inaction of the Police and the ICAC to enquire into the matter especially where the suspect is a Minister and that there is more than a reasonable suspicion and more than prima evidence that he might have committed an offence under both Section 77 of the Criminal Code and Section 7 of the Prevention of Corruption Act ».
En attendant de loger un Main Case au sujet des Constitution Clerk’s Fees, Simla Kistnen exige que « I shall be asking for summons to the Commissioner of Police and to the Director-General of the ICAC to request their officers to interview under warning the said Minister for his wrongful acts and doings which I am advised is an offence under both the Criminal Code and the Prevention of Corruption Act ».
