AMENDE: Harish Boodhoo proteste

Après avoir pris connaissance de notre information publiée dans l’édition du Mauricien en date de mardi 20 décembre 2011, annonçant qu’un homme s’est présenté au greffe de la Cour de district de Port-Louis, pour payer l’amende que cette instance a infligée à Harish Boodhoo, celui-ci nous a fait parvenir une lettre afin de préciser certains détails et nous dire qu’il a protesté auprès des instances appropriées.
Pour rappel, cela s’est passé au moment même où l’avoué de l’ancien leader politique, Me Kaviraj Bokhoree et lui-même présentait sa motion devant le Chef juge, Bernard Sik Yuen, concernant sa demande de pouvoir faire appel devant le Privy Council. L’homme, un inconnu comme le fait remarquer Harish Boodhoo, avait laissé sa carte d’identité nationale, qui indiquait qu’il avait pour nom Richard Luke Munisamy. Devant les protestations du District Clerk du tribunal, il a soutenu qu’il a été envoyé par un dénommé Bacsou. Nul besoin pour nous de faire comprendre à M. Boodhoo que ce n’est pas Le Mauricien qui a inventé cette référence mais bien celui qui est venu pour payer son amende.
Pour l’évidence de nos lecteurs, nous publions volontiers les démarches faites par Harish Boodhoo et son avoué par la suite, tel que le premier nommé nous les a indiquées dans sa lettre.
« 1) The Attorney wrote letters to the District Magistrate + the Chief Justice + the DPP. He informed them that all the institutions were aware of the stay execution motion and yet the District Clerk officials accepted an unknown person to pay the fine. More so, the District Magistrate, His Honour M. Santokeehad called the head clerk on 13th December last to inform him of same. How can a fine be paid when there was an order ?
« 2) I gave a statement to the Pope Henessy Police certifying that : (a) I never sent anybody to pay the fine. I do not know that person. At any rate, The Court Officials were wrong to have accepted the payment when the motion was being debated at the Supreme Court. (b) There was a similar incident in April 2009 when the same Court Officials had allowed another person to pay Rs 1 000 to pay my surety. I had protested.
« As a matter of fact, there’s a plot which was hatched somewhere. And worse, that Munisamy indicated to the Police that my Attorney had given him the Rs 10 000 to pay the fine.
« Come what may, it was du jamais vu. Questions arise : Who plotted ? Who gave Munisamy that money ? Why did he lie ? Why some people are bent upon sending me to prison or destroying me ? And, en passant, somebody who professed his help finally stabbed me. That’s not the first time. I am keeping him at arm’s length. »
En ce qui concerne sa motion devant le Chef juge, il précise que ce dernier a présidé avec calme l’audience spéciale — la Cour suprême étant en congé — d’appel de motions privées. « The Chief Justice will fix another date to give his decision. Whatever be his ruling, I must say, I was impressed and at ease with the calm way he presided. All told, I need justice more than ever », observe Harish Boodhoo.
