DPPGATE: L’Attorney General répond à l’IAP de La Haye

L’Attorney General, Ravi Yerrigadoo, a répondu officiellement à Gerhard Jarosch, président de l’International Association of Prosecutors, dont le siège est basé à La Haye aux Pays-Bas. Cette association avait écrit officiellement pour prendre position en faveur du Directeur des Poursuites Publiques, Me Satyajit Boolell, Senior Counsel, dans le cadre de l’enquête de l’Independent Commission Aganist Corruption dans l’affaire Sun Tan Hotels Pty Ltd.
D’entrée de jeu, l’Attorney General s’est appesanti sur le principe sacro-saint de la séparation des pouvoirs, soit la législature, l’exécutif et le judiciaire, principe garanti par la Constitution. Citant des extraits du jugement de sir Henry Garrioch au sujet de la définition de « democratic state », Ravi Yerrigadoo souligne que « the decisions cited by Lord Steyn do indeed help to give important colour to the guarantee that Mauritius is to be a democratic state. In particular, it is a hallmark of the modern idea of a democratic state that there should be a separation of powers between the legislature and the executive, on the one hand, and the judiciairy on the other ».
L’Attorney General ajoute à l’intention de l’International Association of Prosecutors que « I can confidently state that the doctrine of powers as explained in the case of Koyratty applies in Mauritius ». Soulignant que le DDP a obtenu « relief from the Supreme Court, which in itself, shows that the doctrine of powers applies in Mauritius », il a fait ressortir que par respect pour la Cour suprême, « it would be improper for me to comment any further on the pending case. » « I would invite you, as a responsible international association established at the United Nations Offices in Vienna to also respect the Supreme Court of Mauritius as an institution and further, the Republic of Mauritius as a sovereign and democratic State », conclut l’Attorney General, qui regrette une « breach of etiquette » de la part de l’UAP vu que cette communication a transité par le bureau de l’attaché de presse du DPP.
