JUDICIAL REVIEW — BIBLIOTHÈQUE NATIONALE: Premchand Hauroo débouté

Premchand Hauroo, Officer in Charge intérimaire de la Bibliothèque Nationale, avait voulu contester la décision du National Library Board de maintenir Yves Chan Kam Lon au poste de directeur sur une base contractuelle, après le départ de ce dernier à la retraite. La motion du plaignant a été rejetée par les juges Premila Balgobin et Saheed Bhaukaurally, dans un jugement rendu lundi.
Les juges Premila Balgobin et Saheed Bhaukaurally ont d’emblée fait remarquer lundi que l’avocat du plaignant a concédé qu’aucun Statement of case n’a été soumis au dossier de la motion. « The importance of complying with this procedure has time and again been ruled upon by this Court as an essential requirement for an applicant to state with precision the issues which a respondent must meet and upon which a remedy is being sought from the Court », disent-ils. L’avocat a aussi reconnu que la Cour a adopté une attitude clémente dans certaines circonstances.
Dans le cas présent, les juges ont souligné qu’ils ne sont pas d’accord avec l’avocat quand celui-ci avance que les points ont été soulevés dans les affidavits. De plus, ils font remarquer que les parties reconnaissent que les recommandations contenues dans le rapport du Pay Research Bureau (PRB) de 2008 ainsi que le Report on Errors, Omissions and Clarifications du PRB, également publié en 2008, sont applicables à la Bibliothèque Nationale (BN). Pour les besoins de la cause, il convient de se référer au paragraphe 19 1129 du deuxième rapport susmentionné. Il y est dit : « We recommend that up to the year 2018, an officer in post as at 30 June 2008 who has attained the compulsory retirement age as per the transitional provision of the new Scheme may, with the approval of the members of the Board or the Local Government Service Commission, subject to any other such approval as may be applicable under any other enactment, whichever is appropriate, be allowed to remain in service beyond the age of 60 but not beyond the age of 65, where Government considers that the continuation of his service would be in the interest of the Public Sector. »
Ceci étant, les juges ont estimé qu’il n’y a pas lieu de traiter la demande du plaignant quand il vient dire que « it was not open to respondent N°1 (le National Library Board) to resort to its substantive right under paragraph 19 1128 above quoted to allow respondent N°2 (M. Chan Kam Lon) to remain in post after his retiring age in the interest of the institution ».
Les juges ont finalement noté que, comme le plaignant l’indique, il n’était pas le seul officier — au temps où il avait logé sa motion — qualifié pour agir comme directeur de la BN et qu’il y avait quatre Senior Officers qui pouvaient satisfaire les critères requis pour occuper le poste. Mais ils n’ont pas été mis en cause dans l’affaire.
« We agree with learned Counsel for respondent N°2 that there is no prayer against respondent N°2. In fact this application should have been made in his presence as a Third Party instead against him as a respondent », ont conclu les juges.
