LA BRASSERIE – IRP : la contestation du contrat de Rs 97 M de Sotravic Ltd rejetée

La contestation du contrat alloué à Sotravic Ltd pour la gestion de la station de transfert de La Brasserie a été rejetée par l’Independant Review Panel sur un point technique. Il s’agit du retard d’un jour dans le délai de contestation effectuée par la Compagnie régionale de Services et de l’Environnement (CRSE) Ltée.

« We therefore conclude that the Applicant, CRSE, should have computed time-limit as from 17th september 2019 – the date a decision should have been issued – and not 18th september 2019 when it received a belated document purpoting to be a décision. As such, the application for review has been made one day late and we dismiss the application pursuant to our powers », écrivent les têtes pensantes de l’IRP dans leur jugement.

L’affaire remonte au 31 juillet dernier, lorsque cinq soumissionnaires avaient décidé de soumettre leurs propositions au ministère de l’Environnement à la suite d’un exercice d’appel d’offres international. Sotravic Ltée faisait partie d’un des cinq soumissionnaires. C’est le 5 septembre dernier que CRSE avait été informée que c’est Sotravic Ltée qui a décroché le contrat pour un montant de Rs 97 496 984. Mais CRSE ne voit pas les choses de cette manière. Dans un “Early challenge”, elle soutient que ladite compagnie n’aurait pas dû être sélectionnée en raison d’un conflit d’intérêts.

« If Sotravic is permitted to bid, it would place itself in a serious situation of conflict as it would certify the weight of waste brought to Mare Chicose by its own trucks from the relevant waste. The Public Body failed to take into account that Sotravic Ltd, as operator od Mare Chicose landfill, is in possession of the tonnage of waste and othe related information to the Public Body in the drafting document has hence a Relationship with the public body. This is in direct breach of IIB 6.1 (d) of Bidding documents since Sotravic Ltd has clear conflict of interest », dit-elle.

Le ministère de l’Environnement réagit face à ces remarques, soutenant que l’offre que Sotravic Ltee répond au critère d’éligibilité. « Sotravic Ltee meets the eligibility criteria. Sotravic does not certify the weight of waste received by the trucks of the operators of different transfer station », a-t-il précisé. Après avoir analysé les faits, il se dit conscient que cette instance a récemment annulé le contrat de Sotravic Ltd pour la station de transfert de La Laura pour un cas similaire.

« We are conscious of the Transfer station operators contracts and Mare Chicose operator contrat when we have recently annulled the procurement proceedings in the related contract of La Laura Transfer Station but we feel that the law required certainty in its application to meet its ends it wishes to achieve. We also wish to point out that this decision should bit be an encouragement to public bodies to keep quiet and regularly fail to issue their decisions in time and respond only at review mechanism that public bodies provide their views at challenge stage, and this Panel will not take such failures lightly », conclut l’IRP.
